Terms of Service for Members

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE SIGNING UP TO BECOME A MEMBER

1.      Introduction

1.1. Contract

By clicking “Sign Up” you are agreeing to enter into a legally binding contract with Darogan Talent (“Contract”). This Contract governs your use of Darogan Talent’s members area on its site (www.darogantalent.cymru/) and related services (“Services”).

If you do not agree to this Contract, do not click “Sign Up” (or similar) and do not access the members area on our site.

If you wish to terminate this Contract at any time you can do so by closing your account and no longer accessing or using the Services.

1.2. Who we are

Darogan Limited trading as ‘Darogan Talent’ is a company registered in England and Wales (referred to as “Darogan Talent” or “we” in these terms). Our company registration number is 14480962 and our registered office is at Ty Cefn, Rectory Road, Cardiff, United Kingdom, CF5 1QL.

1.3. Members

When you sign up to create a profile on Darogan Talent, you become a registered member (“Member”).There is no charge to become a Member.

1.4 Other terms that apply

The following additional terms also apply to your use of our Services:

·      Our Terms of Website Use, which sets out the terms for using our site.

·      Our Privacy Policy, which sets out how we use your personal information.

·      Our Acceptable Use Policy, which sets out the permitted uses and prohibited uses of our site. When creating and managing your profile, you must comply with the content standards set out in our Acceptable Use Policy.

·      Our Cookie Policy, which sets out information about the cookies on our site.

 

2.       Obligations

 

2.1. Eligibility

To become a Member, you must:

(a)   be over the age of 18; and

(b)   provide accurate information about yourself (such as your name).

By entering into this Contract, you confirm that you are over the age of 18 and the information you have provided is accurate.

Creating a profile with false information is a breach of this Contract.

3.       Rights and Limits

 

3.1. Licence

You retain all of your ownership rights in relation to the content and information (including any photographs) that you provide. However, you grant Darogan Talent a worldwide, non-exclusive, royalty-free, transferable licence to use, store, publish and process this content and information.

You confirm that the content and information you provide does not incorporate any material that infringes the copyright or any other rights of any third party nor does it contain any obscene, blasphemous or defamatory matter.

You can end this licence at any time by:

a)       deleting such information and content from your profile; or

b)      by closing your account.

 

3.2.  Our right to suspend or terminate your account

Darogan Talent reserves the right to restrict, suspend, or terminate your account if you breach this Contract or are misusing the Services (e.g. by violating the content standards set out in our Acceptable Use Policy).

3.3. Use of your personal data

As part of our Services, we will use your personal information to recommend jobs to you and make recommendations for features that may be useful to you. Keeping your profile accurate and up to date helps us to make these recommendations more accurate and relevant. For further details about how we will use and process your personal data, please see our Privacy Policy.

3.4 Other members’ profiles

The membership area on our site will include information and materials uploaded by other members. This information and these materials have not been verified or approved by us. The views expressed by other members or users on our site do not represent our views or values.

3.5 No warranties

We make no representations, warranties or guarantees, whether express or implied, that the content on our site, including the information on members’ profiles, is accurate, complete or up to date.

We do not guarantee that our site, including your account, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our site (including your account) for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.

4.       Termination

Both you and Darogan Talent may terminate this Contract at any time by notifying the other. On termination, you lose the right to access or use the Services.

5.       Limitation of liability

To the extent permitted by law, we shall have no liability to you for any loss of profit, loss of business, business interruption, loss of business opportunity or any indirect or consequential loss or damage arising under or in connection with this Contract. Nothing in this Contract, excludes or limits in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

6.       Other important terms

 

6.1   Our right to transfer this Contract

We may transfer our rights and obligations under this Contract to another organisation. We will ensure that the transfer will not affect your rights under this Contract.

6.2   Governing law

Any dispute or claim arising out of or in connection with this Contract, its subject matter or formation shall be governed by and construed in accordance with the law of England and Wales.

If you are a business, you and we both agree to submit all disputes arising out of or in connection with the Contract to the exclusive jurisdiction of the English courts.

If you are a consumer, you and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
